浅议“武大郎”商标之驳回通知书|知识产权律师陈高乾

看到“武大郎”这三个字,您第一时间想到的是什么呢?水浒传、潘金莲、武松还是烧饼,即使千思万想,他也只是《水浒传》里的虚构人物而已。
在当今营商环境下,知识产权保护引发全社会的高度关切,已成为最重要的议题之一,现如今很多中小型企业想尝试打造自己的品牌IP,那用“武大郎”来注册商标行不行呢?

2020年1月14日在微信朋友圈盛传的一张商标驳回通知书引发网友戏谑讨论,有意思的是其内容,只见商标驳回通知书上赫然写着:“武大郎”为我国烈士,用作商标易产生不良的社会影响,不得作为商标使用。

那该图是否为PS的呢?真实性存疑,笔者也带着疑问去确认其真实性,通过该商标的申请时间进行检索,发现上述商标驳回通知书所提及的商标为第40018052号“武大郎”商标,该商标申请使用在25类服装鞋帽中的服装;童装;鞋;帽;袜;领带等商品。
据查询数据显示,该“武大郎”商标系李XX于2019年7月30日提出申请,同年8月22日商标局受理,而在朋友圈盛传的上述商标驳回通知书是在2020年1月7日发出,从时间上分析,这份商标驳回通知书是合理的。
那既然时间上是合理的,那是否有这位名为“武大郎”的烈士呢?

据《中华英烈网》烈士英名录中记载,武大郎确为革命烈士,但此“武大郎’非彼“武大郎”,那么该商标驳回通知书就有很大几率为真实的。



据查询数据显示,该“武大郎”商标系李XX于2019年7月30日提出申请,同年8月22日商标局受理,而在朋友圈盛传的上述商标驳回通知书是在2020年1月7日发出,从时间上分析,这份商标驳回通知书是合理的。

那既然时间上是合理的,那是否有这位名为“武大郎”的烈士呢?
据《中华英烈网》烈士英名录中记载,武大郎确为革命烈士,但此“武大郎’非彼“武大郎”,那么该商标驳回通知书就有很大几率为真实的。
A trademark rejection notice circulated on WeChat's circle of friends on January 14, 2020 sparked discussion among netizens. What was interesting was the content. WE saw the trademark rejection notice stating: "Wu Dalang" is a martyr in China and WOULD have adverse social impact IF USING AS A TRADEMARK, THEREFORE should not be used as a trademark.
Is the picture A PS? The authenticity is in doubt, the author also took the question to confirm its authenticity, and searched through the application time of the trademark. It was found that the trademark mentioned in the notice of rejection of the trademark was the "Wu dalang" trademark No. 40018052. The trademark application was used in 25 Clothing in footwear and hats; children's clothing; shoes; hats;socks;ties and other commodities.
According to the inquiry data, the "Wu Dalang" trademark was filed by Li XX on July 30, 2019, and was accepted by the Trademark Office on August 22 of the same year.The above-mentioned trademark rejection notice circulated in the circle of friends was issued on January 7, 2020.Analysizing from the perspective of tim,this trademark rejection application is reasonable.
Since time is reasonable, is there a martyr named "Wu Dalang"?
According to statements from the Chinese Martyrs' List, Wu Dalang is indeed a revolutionary martyr, but this "Wu Dalang" is not another "Wu Dalang", then there is a great chance that the trademark rejection notice is true.


但笔者在检索中发现,申请“武大郎”相关商标的共有73件,其申请类别也几乎覆盖全类别,其中也有不少已成功注册,这又是为什么呢?
2018年4月27日,由中华人民共和国第十三届全国人民代表大会常务委员会第二次会议通过且公布的《中华人民共和国英雄烈士保护法》,自2018年5月1日起施行,其第二十二条规定如下:
第二十二条 禁止歪曲、丑化、亵渎、否定英雄烈士事迹和精神。
英雄烈士的姓名、肖像、名誉、荣誉受法律保护。任何组织和个人不得在公共场所、互联网或者利用广播电视、电影、出版物等,以侮辱、诽谤或者其他方式侵害英雄烈士的姓名、肖像、名誉、荣誉。任何组织和个人不得将英雄烈士的姓名、肖像用于或者变相用于商标、商业广告,损害英雄烈士的名誉、荣誉。
公安、文化、新闻出版、广播电视、电影、网信、市场监督管理、负责英雄烈士保护工作的部门发现前款规定行为的,应当依法及时处理。

On April 27, 2018, the Law of the People's Republic of China on the Protection of Heroes and Martyrs adopted and promulgated by the second meeting of the Standing Committee of the 13th National People's Congress of the People's Republic of China came into effect on May 1, 2018. Article 22 provides as follows:
Article 22: It is forbidden to distort, vilify, desecrate, or deny the deeds and spirit of heroes and martyrs.
The names, portraits, reputations, and honors of heroes and martyrs are protected by law. No organization or individual is allowed to insult, defame, or otherwise infringe the names, portraits, reputations, and honors of heroes and martyrs in public places, the Internet, or using radio, television, movies, publications, and so on. No organization or individual may use the name or portrait of a hero martyr in disguise or use it in trademarks or commercial advertisements, thereby damaging the reputation and honor of the hero martyr.
The departments of public security, culture, press and publication, radio and television, film, online information, market supervision and management, and the protection of heroes and martyrs shall discover the acts prescribed in the preceding paragraph in a timely manner according to law.

1、在注册自己的品牌IP时,应注意规避名人姓名、艺名、笔名等“搭便车”行为;
2、避免恶意抢注、恶意囤积、注册成功后长期不使用等行为;
3、当然最重要的还是申请注册商标前,一定要做好前期检索工作,建议委托专业代理机构,避免劳神伤财,得不偿失。

综上来看,中华上下五千年的文化固然博大精深,但重名率也是相当高的,如此“一刀切”的禁用英雄烈士姓名作为商标使用的行为,是否妥当,笔者认为有待商榷!

❷企业经营者作为行业的知名人物,如与英雄烈士重名,以个人姓名申请商标,应如何认定?
❸《中华人民共和国民法通则》第九十九条关于姓名权、名称权的规定:“【姓名权、名称权】公民享有姓名权,有权决定、使用和依照规定改变自己的姓名,禁止他人干涉、盗用、假冒。
法人、个体工商户、个人合伙享有名称权。企业法人、个体工商户、个人合伙有权使用、依法转让自己的名称。”是否与《中华人民共和国英雄烈士保护法》第二十二条相互矛盾?
